Fire season has now begun. It is a legislative requirement that all fires must have a permit before being lit. 

SHIRE OF CENTRAL DARLING
PREVENTION OF BUSH FIRES
 The public is notified to comply with the under-   mentioned requirements before the following classes of fire may   be lit during the
 
 
 
BUSHFIRE DANGER PERIOD
From 1st OCTOBER, 2006 to 31st MARCH, 2007 and other times declared by Council
 
 
 
For the purposes of BURNING HOUSEHOLD WASTE, ROUTINE AGRICULTURAL PURPOSES, VEGETATION BURNS, BURNING OF FIRE BREAKS AND OTHER WASTE PRODUCTS
 
 
 
a)      A permit must be first obtained.
b)      Notice must be given to the adjoining landholders, Fire Control personnel and the permit Issuing Officer before the fire is lit.
c)      At least one person must be in attendance at the fire during the whole time it is burning.
d)      Any other conditions as nominated on the permit must     be observed.
 
 
 
A permit is not required for a person to light a fire in the open to cook, heat or prepare meals or to boil water or for any like purpose, any such fire must comply with the following guidelines and must not be lit unless it is:-
a)      in a permanently constructed fireplace within 2 metres of which the ground is clear of all combustible matter, or
b)      at a site within 3 metres of which the ground is clear of all combustible matter.
When fire permits are issued for vegetation burns, they are not to be considered to be approvals to clear land & are not designed to allow for the clearance of native vegetation, threatened species or areas subject to tree preservation orders contrary to the requirements of other laws, which govern their clearance.
It is the responsibility of the applicant to determine if any environmental approval is required and to obtain that approval.
 
 
 
On days where TOTAL FIRE BANS are declared all current permits are suspended for the duration of such Total Fire Ban.
 
 
 
MAXIMUM PENALTY FOR FAILURE TO
COMPLY WITH THESE REQUIREMENTS
- $5000 OR 12 MONTHS IMPRISONMENT

ISSUING OF FIRE PERMITS
 
 
Permits to light fires in the CENTRAL DARLING Shire during the Fire Restriction Period (1st October, 2006 to 31st March, 2007)  are available from various rural fire brigades.

Section 87 of the Rural Fires Act 1997 reads:-
A person who lights a fire on land for the purpose of land clearance or for burning any fire break during a bush fire danger period that applies to the land is guilty of an offence unless the person:
a)         is authorised to do so by a fire permit issued by the appropriate authority and the person complies with any conditions set out in the fire permit, and
b)         has given notice in accordance with section 86.
Clause 30 of the Rural Fires Regulation 1997 establishes that:
1)         For the purposes of Section 86 of the Act, the prescribed notice is a written or oral notice that includes particulars of the location, purpose and time of the fire proposed to be lit.
2)         The notice must be given to each of the persons referred to in subclause (3) at least 12 hours before the fire is lit.
3)         For the purposes of Section 86 of the Act, the prescribed persons are:
a)         the occupiers (or if there is no occupiers, the owners) of all land contiguous to, or that is separated merely by a lane, road or waterway (whether fenced or unfenced) from the land on which the fire is to be lit, and
b)         the relevant local authority.
