Section 7.12 of the Environmental Planning and Assessment Act 1979 (EP&A Act) authorises Council or a private certifier to impose as a condition of development consent, the payment of a fixed development contribution levy relating to the cost of works when a development consent or complying development certificate is issued.\
The development contributions levy is applied on a sliding scale, ranging from nil to 1% of the total cost of works. There is an option for the applicant to choose either the contribution levy or to enter a Voluntary Planning Agreement, the applicant may offer to pay money, dedicate land, carry out works, or provide other material public benefits for public purposes.
It is proposed that the draft s7.12 Plan 2024 be placed on public exhibition for a period of 28 days in accordance with the EP&A Act and the Environmental Planning and Assessment Regulation 2021 (EP&A Regulation). Following public exhibition , with submissions reviewed, the plan will be finalised and put to council to adopt the draft Central Darling Shire Council - S7.12 Infrastructure Contributions Plan 2024.
